In the event that the legatee dies before the testator:
1. If the legatee dies before the testator, the provisions of the will that specifically bequeath assets to the deceased legatee shall lapse in accordance with the Civil and Commercial Code, Section 1698 (1).
2. The assets and rights in that portion shall revert to the estate of the testator.
3. This shall not affect other provisions stipulated in the will.
If the testator wishes to bequeath property to heirs or other persons, they may do so by making a will. If, after making the will, the beneficiary dies before the testator, the property and rights bequeathed to the beneficiary shall lapse and revert to the testator’s estate in that portion, but shall not affect other portions that the testator has specified for bequest to the persons named in the will, in accordance with the Civil Code, Section 1698 (1).
