Children and youth: To what extent can they enter into legal acts and contracts?

refers to an action performed by a person in accordance with the law that is intended to produce legal effects. These effects can include the exercise, creation, modification, transfer, reservation, or termination of rights.

What is a contract?

A contract is an agreement between two parties to do or refrain from doing something. Contracts are usually in written form, specifying the terms and conditions, and are signed by both parties. It may also include witnesses.

For minors or youths to enter into legal acts or contracts, it depends on their age and the type of legal act or contract. According to Thai law (Civil and Commercial Code), there are established criteria for this:

📌 1. Age and Legal Capacity

  • Under 7 years old:
    They cannot enter into any contracts, except when the contract is for a one-sided benefit with no obligations (e.g., receiving a gift).
  • Ages 7 to 20 (minors, not yet of legal age):
    They can make contracts but must obtain consent from their legal guardian for the contract to be valid.
  • Over 20 years old:
    They are considered to have reached full legal capacity and can enter into contracts freely.

📝 2. Types of Contracts Minors Can Make

  • One-sided benefit contracts (no obligations, such as receiving gifts or rewards) ✅
  • Necessary daily life contracts (e.g., buying food or basic necessities) 🛒
  • Other contracts, such as purchasing expensive items, borrowing money, or leasing a car → must get guardian’s consent.

⚖️ 3. What Happens if a Minor Signs a Contract Without Consent?

Such a contract is “voidable” (can be annulled) by the guardian or the minor once they reach legal age.

Example scenarios:
🔹 Boy A (16 years old) buys a mobile phone worth 30,000 THB without parental consent → The store is at risk because the guardian can cancel the contract. 📱💥

🔹 Girl B (10 years old) wins a prize from a singing contest → This is allowed because it’s a one-sided benefit contract. 🎤🏆

Summary:
Minors can enter contracts in certain cases, but for significant transactions, parental consent is required for the contract to be fully valid.
