A subsequent marriage registration is equivalent to not being registered at all.
Bigamy is when a man or woman who is already legally married to someone else goes and registers their marriage with another person. In other words, it is when a man or woman registers their marriage with another person while they are still legally married to someone else.
If your spouse remarries someone else, you can file a petition with the court to have the marriage declared void.
 

In addition, you can also pursue other avenues of claim, such as:

  • File for divorce
  • Claim compensation from the adulterer
  • Claim compensation from the spouse
  • Request the responsible spouse to pay alimony if the divorce impoverishes the “husband or wife” due to insufficient income from assets or previous employment during the marriage
  • File for child support

Section 1452 of the Civil and Commercial Code a man or woman is not allowed to marry while they are legally married to another person. This provision prohibits a man or woman from marrying while they are already married, in accordance with the principle of family law that allows only one spouse. If a person commits bigamy or marries while already married, that marriage is void according to Section 1495. Any interested person may claim that the marriage is void or file a case with the court to request a court ruling that the marriage is void. However, if no such claim or ruling has been made, the man and woman in the subsequent marriage are still considered legally married. But once a claim is made or a ruling is issued, the bigamous marriage is null and void from the beginning.
