Engagement Gifts are assets given by the man to the woman (fiancée) as evidence that they will marry. The engagement gift immediately becomes the fiancée’s property. The engagement has legal effects because once the engagement occurs, the gift automatically becomes the woman’s property.
Legal Requirements for Engagement Gifts:
- The gift must be property : It can be movable property (personal property) or immovable property (real estate) and may also include rights with monetary value, such as copyrights.
- The gift must be given by the man to the woman : The engagement is only complete when the man gives the engagement gift to the woman. Any property given by the woman to the man is not considered an engagement gift and does not complete the engagement under the law.
- The gift must be given at the time of the engagement : A promise to give the gift in the future does not count as an engagement gift, even if the property is given later as promised. If the gift is immovable property, the ownership must be transferred. Merely handing over a property deed with a ribbon is not sufficient.
- The gift must be given with the intention to marry : The gift is meant to demonstrate the intention to marry. If the man and woman do not intend to marry and register the marriage legally, the gift is not considered an engagement gift but rather a gift of affection or another form of agreement.
For the engagement to be legally binding, these conditions must be met.
What Happens if the Engagement Contract is Breached?
If the woman breaches the engagement contract : If the woman breaches the engagement contract or cancels the engagement, the man has the right to reclaim the engagement gift from the woman, meaning the gift must be returned to the man.
If the man breaches the engagement contract : If the man breaches the engagement contract or cancels the engagement, the woman is not required to return the engagement gift to the man, meaning the gift remains the woman’s property.
In general, breaching the engagement contract will have consequences according to the law, and the party at fault will be responsible for the consequences as specified by the law.
The party not at fault for breaching the engagement contract can claim compensation according to Section 1440 of the Civil and Commercial Code. Compensation may be claimed for the following:
- Compensation for damage to the body or reputation: If the breach causes harm to the person’s health or reputation.
- Compensation for expenses related to wedding preparations: If the other party has already incurred costs in preparation for the wedding.
- Compensation for damage caused by the fiancé(e) managing property or work with the expectation of marriage: If one party made decisions regarding their property or career based on the expectation of marriage and suffered losses as a result of the engagement being called off.
These types of damages aim to compensate the affected party for the losses incurred due to the breach of the engagement contract.
