Illegitimate child

A couple who cohabit as husband and wife without being legally married, if they have a child, the law will call the child an “illegitimate child,” which is considered the legitimate child of only the woman or mother

However, if a father openly provides for and supports his child, pays for the child’s education, or allows the child to use his surname, which is considered an acknowledgment of paternity by conduct or in fact, then the child has the right to inherit as a natural heir of the father. The child is considered a descendant, just like a legitimate child.
 
👪 An illegitimate child can inherit from the father only if the father legally acknowledges them, divided into these 3 cases.
     1. To the district office or the amphoe office to process the certification with the consent of the minor’s mother.
     2. To petition the Juvenile and Family Court to order the father to be the legal father.
     3. In the case where the father has passed away, the child wishing to inherit the father’s estate must petition the court to be legally recognized as the deceased’s child.
