If parents separate, who has the right to custody of the child?

Divorce may terminate the status of a family, but the status of a parent cannot be ended. When a separation or divorce occurs, the division of child custody becomes a delicate matter due to the reasons for the divorce, the readiness of each party, and their willingness to agree. Some couples can reach an agreement, while others cannot and must resort to the courts. This situation can be divided into two cases.

✨ When the parents are in a legally recognized marriage
Parents must agree on how they will jointly care for their child. Alternatively, if there are two children, they may agree to share custody. However, if they cannot reach an agreement, they must resort to litigation for a court to make a decision.
 
✨ In cases where the parents are not legally married, the mother has sole parental rights over the child
If the mother wishes for the father to provide financial support for the child, she must take legal steps to establish the father’s legal paternity.
If the father desires to have custody of the child, he must either register the child as his own, subsequently marry the mother, or file a lawsuit to seek custody
