Royal Gazette Announcement on Legal Amendment: Prohibition Against “Punishing Children”

On March 24, 2025, the Royal Gazette published the Act Amending the Civil and Commercial Code (No. 25), B.E. 2568, which came into effect on March 25, 2025.

🔹 Key Provisions

Section 1567 (2) of the Civil and Commercial Code has been amended as follows:

“A person exercising parental power has the right to discipline their child for the purpose of instruction or behavioral correction, provided that it does not constitute abuse or inflict physical or mental harm, or involve any improper conduct.”

🔹 Meaning and Implications

  • The amendment preserves the right of parents or guardians to educate and guide their children, but such actions must not involve violence or abuse.

  • It prohibits punishment that constitutes abuse, such as beating, physical assault, emotional harm, or degrading treatment.

  • “Improper conduct” refers to actions like verbal humiliation, shaming, or excessive punishments that are not proportionate to the child’s behavior.

🔹 Social Impact

  • Promotes child-rearing practices that respect the rights and dignity of children.

  • Aims to reduce violence within families and promote positive, constructive discipline.

  • Aligns with the United Nations Convention on the Rights of the Child, to which Thailand is a signatory.
